Man Gets DUI After Leaving Car Running at Gas Pump for 40 Minutes

The driver, from Oakland, displayed objective signs and symptoms of driving while under the influence of alcohol.

 

Police responded to a gas station at the 800 block of Willow Avenue around 3 a.m. Tuesday after a caller said a male adult had been sitting in an Acura Legend at the gas pumps with the engine running. According to Hercules Police: 

The reporting party said the man had been there approximately 40 Min. As the first officer arrived he saw an Acura Legend leaving the shopping center.  The vehicle had a headlight out and was stopped for the traffic violation. The driver displayed objective signs and symptoms of driving while under the influence of alcohol.  He also had two outstanding warrants for alcohol related charges.  46 year old Hayward Gaines, of Oakland, was arrested for Driving Under the Influence of Alcohol and outstanding warrants.  He was transported to the Martinez Detention Facility.
